OVERVIEW
This website is operated by DARK COLLECTABLES S.R.L. Throughout the site, the terms “Dark Collectables”, “we”, “us” and “our” refer to DARK COLLECTABLES S.R.L.
Dark Collectables operates this online store and provides the website, information, content, products, features and related services available through it (the “Services”). Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.
These Terms of Service (“Terms”) govern your access to and use of the Services and any purchases made through darkcollectables.com.
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, you should not use the Services.
Nothing in these Terms limits or excludes any mandatory rights granted to consumers under Romanian or European Union law.
1. ELIGIBILITY AND CUSTOMER ACCOUNTS
You must have the legal capacity required under applicable law to enter into a purchase contract.
Certain features may require a customer account. You are responsible for ensuring that the information associated with your account is accurate and up to date and for maintaining the security of your account access.
You must not misuse another person’s account or provide false or misleading information when creating or using an account.
We may restrict or suspend access to an account where reasonably necessary to protect the customer, the store or other users, or where we reasonably believe the account is being used unlawfully or fraudulently.
2. PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, images, specifications, availability and other information displayed on the website are accurate.
Product images are provided for presentation purposes. Colours and appearance may vary slightly depending on your device, display settings, packaging revisions or manufacturer updates.
Official product names, artwork, trademarks and other intellectual property associated with Pokémon, Magic: The Gathering, One Piece Card Game, Yu-Gi-Oh!, Riftbound, Digimon Card Game, Disney Lorcana and other products belong to their respective rights holders.
We may correct errors or update product information where necessary.
Products are offered subject to availability.
3. ORDERS AND CONTRACT FORMATION
Submitting an order constitutes an offer to purchase the products included in that order.
After you place an order, you may receive an automatic confirmation that the order was received. This acknowledgement does not necessarily constitute final acceptance of the order.
The sales contract is concluded when Dark Collectables confirms acceptance of the order on a durable medium, such as by email, in accordance with applicable law.
We may refuse or cancel an order before acceptance where there is a legitimate reason, including:
- an obvious pricing or product-information error;
- suspected fraud or unauthorised payment;
- inability to supply the ordered product;
- supplier or distributor allocation issues;
- technical errors affecting the order;
- restrictions imposed by law.
If payment has already been collected for an order that we cannot accept or fulfil, the applicable amount will be refunded.
4. PREORDERS
Dark Collectables may offer certain products as preorders.
For the purposes of our store, a product may be classified as a preorder whenever it is not physically available in Dark Collectables stock at the time the customer places the order. This may include both products that have not yet been officially released and products that have already been released but have not yet reached our inventory.
Preorder pages may display information such as:
- order deadline;
- release date or estimated release date;
- estimated arrival at Dark Collectables;
- preorder status;
- available preorder quantity.
Release and arrival dates are estimates unless expressly stated otherwise.
Publishers, manufacturers, distributors or logistics providers may change release dates, delivery schedules or allocated quantities. Where a meaningful change affects an accepted preorder, we will update the relevant information where reasonably possible and communicate significant changes to affected customers.
Preorder quantities may also be subject to distributor or supplier allocation.
If Dark Collectables ultimately cannot fulfil an accepted preorder, the amount paid for the unavailable product will be refunded.
Statutory consumer rights are not affected by the preorder status of a product.
5. MIXED ORDERS
An order may contain both products currently available in stock and preorder products.
The handling of mixed orders may depend on the products involved and the available shipping options.
Where relevant, information about mixed-order processing will be displayed on the website, during checkout or communicated to the customer.
We will not charge an additional shipping fee for a split shipment without disclosing or agreeing that cost with the customer.
6. PRICES AND PAYMENT
Prices displayed on the store are the prices applicable at the time an order is placed, subject to correction of obvious errors.
Applicable taxes are included or displayed as required by law.
Shipping costs and any other applicable charges are displayed before the customer completes the purchase.
Available payment methods are shown during checkout.
You agree to provide accurate billing and payment information and to use only payment methods that you are authorised to use.
We may cancel or place an order on hold where payment cannot be authorised or where fraud-prevention checks reasonably require additional review.
7. SHIPPING AND DELIVERY
Available delivery methods, shipping costs and other applicable delivery information are displayed during checkout or on our Payment & Delivery information page.
Any delivery or arrival dates displayed by Dark Collectables are estimates unless expressly stated otherwise.
We are not responsible for delays caused by circumstances outside our reasonable control, including carrier disruptions, customs processing, publisher delays, supplier delays or force majeure events. This does not affect any mandatory consumer rights.
For consumer purchases, the risk of loss or damage to goods passes to the customer when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods, except where applicable law provides otherwise.
Tracking information will be provided where tracking is available for the selected delivery service.
8. RIGHT OF WITHDRAWAL AND RETURNS
Consumers purchasing at a distance generally have the right to withdraw from an eligible purchase within 14 days without providing a reason, subject to the exceptions and conditions provided by applicable law.
For goods, the withdrawal period generally begins when the consumer, or a third party designated by the consumer other than the carrier, receives physical possession of the goods.
Certain products or situations may be excluded from the statutory right of withdrawal where permitted by law.

Nothing in our Refund Policy or these Terms limits mandatory rights granted by applicable consumer-protection law.
9. PRODUCT CONFORMITY
Products sold to consumers benefit from the statutory rights concerning conformity of goods provided by applicable Romanian and European Union law.
If a product is defective, damaged, incorrect or otherwise non-conforming, please contact us as soon as reasonably possible so that the situation can be reviewed.
Any commercial warranty offered by a manufacturer or by Dark Collectables is additional to, and does not replace, statutory consumer rights.
10. CANCELLATIONS
Customers may request cancellation of an order before fulfilment.
Whether a cancellation can be completed immediately may depend on the status of the order, payment processing and whether fulfilment has already begun.
This section does not limit any statutory right of withdrawal or other mandatory consumer right.
11. INTELLECTUAL PROPERTY
Unless otherwise stated, the website design, original text, branding, graphics and other original Dark Collectables content are owned by or licensed to DARK COLLECTABLES S.R.L. and are protected by applicable intellectual-property laws.
You may use the website for personal and lawful purposes.
You may not reproduce, distribute, modify, commercially exploit or republish Dark Collectables-owned content without permission, except where permitted by law.
Third-party trademarks, logos, product artwork and other intellectual property remain the property of their respective owners.
Dark Collectables does not claim ownership of third-party trading card game brands or intellectual property.
12. ACCEPTABLE USE
You must not use the Services:
- for unlawful or fraudulent purposes;
- to infringe the rights of another person;
- to transmit malicious software or harmful code;
- to interfere with the security or proper operation of the website;
- to attempt unauthorised access to accounts or systems;
- to submit false or misleading information;
- to conduct abusive automated activity, scraping or other activity that materially disrupts the Services;
- to send spam or other unauthorised communications.
We may take reasonable technical or account-level measures to prevent misuse of the Services.
13. THIRD-PARTY SERVICES AND LINKS
The Services may contain links to or integrations with third-party services, including payment providers, delivery providers, authentication providers and other platforms.
Third-party services may be governed by their own terms and privacy policies.
We are not responsible for independent third-party websites or services outside our reasonable control, except where applicable law provides otherwise.
14. RELATIONSHIP WITH SHOPIFY
Dark Collectables is powered by Shopify, which provides the ecommerce infrastructure used to operate the store.
Purchases made through Dark Collectables are transactions between the customer and DARK COLLECTABLES S.R.L., not between the customer and Shopify.
Shopify may process certain information as necessary to provide its platform and related services.

15. PRIVACY AND PERSONAL DATA

Because the store is hosted using Shopify, certain personal information may also be processed by Shopify and other service providers involved in operating the store, processing payments, providing authentication or fulfilling orders.

16. ERRORS AND TECHNICAL ISSUES
Occasionally the website may contain typographical errors, incorrect availability information, inaccurate pricing or other technical issues.
We reserve the right to correct such errors.
If an error materially affects an order that has already been submitted, we will contact the customer where appropriate.
Nothing in this section permits Dark Collectables to disregard a contract already concluded where doing so would violate applicable law.
17. SERVICE AVAILABILITY
We aim to keep the website and Services available and functioning correctly but cannot guarantee uninterrupted availability.
Access may occasionally be interrupted for maintenance, security reasons, technical problems or circumstances outside our reasonable control.
We may modify or discontinue website features where reasonably necessary.
18. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer rights.
To the extent permitted by law, Dark Collectables is not responsible for indirect losses that were not reasonably foreseeable at the time the contract was concluded or for losses resulting solely from circumstances outside our reasonable control.
These Terms do not exclude liability for fraud, wilful misconduct, personal injury caused by negligence where liability cannot legally be excluded, or any other liability that cannot be excluded under applicable law.
19. FORCE MAJEURE
Dark Collectables will not be responsible for a failure or delay in performing an obligation where that failure or delay results from circumstances beyond our reasonable control.
Such circumstances may include major transport disruptions, natural disasters, government actions, widespread technical failures, labour disruptions, supply-chain interruptions or similar events.
Mandatory consumer rights remain unaffected.
20. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will apply only to the maximum extent permitted by law and the remaining provisions will continue in effect.
21. CHANGES TO THESE TERMS
We may update these Terms from time to time, including to reflect changes to the Services, business operations or applicable law.
The current version will always be published on this page together with the date of the latest update.
Where required by law, material changes will be communicated appropriately.
Changes will not retroactively remove rights already acquired by customers under existing contracts.
22. GOVERNING LAW AND CONSUMER RIGHTS
These Terms and contracts concluded through Dark Collectables are governed by Romanian law.
If you are a consumer, this choice of law does not deprive you of any mandatory consumer protections that apply to you under applicable Romanian or European Union law.
Any dispute will be handled by the courts or competent authorities determined in accordance with applicable law.
Where possible, we encourage customers to contact us first so that we can attempt to resolve issues directly.
